Dispute Resolution Policy for Lazy Pygmy

(“we,” “us,” or “our”) and users of LazyPygmy.com (“you” or “user”). This policy complies with the laws of the State of Pennsylvania, United States, and the Republic of Liberia.

 

1. Scope of Policy

This policy applies to disputes arising out of or related to your use of LazyPygmy.com, including:

Contractual disputes regarding purchases or services.

Allegations of website misuse or unauthorized activity.

Claims involving privacy, intellectual property, or other legal matters.

 

2. Initial Resolution Attempt

3. Mediation and Arbitration

A. Mediation
If the dispute cannot be resolved informally, both parties agree to submit the matter to mediation. Mediation is a voluntary process facilitated by a neutral third party aimed at achieving a mutually acceptable resolution.

Mediation will take place in either Pennsylvania, U.S., or Monrovia, Liberia, depending on your location.

The costs of mediation will be shared equally unless otherwise agreed.

B. Arbitration
If mediation fails, the dispute will be resolved by binding arbitration.

Arbitration in the U.S. will be conducted under the rules of the American Arbitration Association (AAA).

Arbitration in Liberia will be conducted under the rules of the Liberian National Bar Association (LNBA) or another mutually agreed-upon body.

Arbitration decisions are final and enforceable in the courts of Pennsylvania or Liberia, as applicable.

C. Exceptions to Arbitration
Either party may seek injunctive relief for intellectual property disputes or other urgent legal matters in the appropriate court before proceeding with arbitration.

 

4. Governing Law

All disputes will be governed by the laws of:

The State of Pennsylvania, U.S., for users in the United States.

The Republic of Liberia, for users in Liberia.
In the event of a conflict of laws, the provisions of this policy will prevail.

 

5. Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class actions or collective legal proceedings.

 

6. Limitation on Claims

Any claim against Lazy Pygmy, Inc. must be filed within one (1) year from the date the dispute arises. Failure to file within this timeframe will result in the claim being permanently barred.

 

7. Court Jurisdiction for Appeals

In rare cases where arbitration awards or decisions are appealed:

Disputes under U.S. jurisdiction will be heard in the state or federal courts of Pennsylvania.

Disputes under Liberian jurisdiction will be heard in the courts of Monrovia, Liberia.

 

8. Changes to This Policy

We reserve the right to update or modify this Dispute Resolution Policy at any time. Changes will be posted on LazyPygmy.com, and continued use of the website constitutes acceptance of the updated terms.
